High Profit Not Justified.
"With regard to the rainproof coat case, tho profit was clearly unreasonably Etgh, and there was no trade usage bo justify it. ■ "With regard to the question of costs in tho alarm clock cases, it may bo urged that the local tribunal of tho Board of Trade failed to summon any of the defendants before it to give their version of the facts. The. duty of the local tribunal ends when a prima faeio case has been established. Such a case was established against each of the defendants, tho informations against whom Have been dismissed. I shall thereforo follow the usual course and make no order as to costs against the Crown. It would, however, save useless and harassing litigation if local tribunals, beforo reconimending the laying of an information, gave those proposed to be charged a ehanco of making such explanations as to them ipight 6eem expedient, though it is to 'be hoped, if those persons are subjected 'to the inquisitorial powers 'conferred by the statute ou local tribunals, they, will not subsequently complain that prior to being summoned before an ordinary tribunal they were placed on the rack by a modern'economio star chamber." IF was stated that the D.I.C. intended to appeal, and security, was fixed at jUOO. In reply, to counsel, who suggested tKnt the Crown might wish to appeal in the alarm clock cases, the Magistrate stated that the Crown'would not. require any security.
