SODA CEYSTALS AND RESII^ The dispute between Allender and Co. (Mr. 11. P. von Haast) and J. J. Croriin, trading as the Wood-King Firelighters (for whom Mr: R. Kennedy appeared, a claim for £32 4s. 6d., was heard by Mr. W. O, Kiddcll, S.Jf. Tho case for the plaintiffs was that' in October, 1918, the defendant : .asl;ed for and was supplied with two tons of soda crystals. Tho defendant then offered to sell to the plaintiffs two tons of resin, which the defendant alleged was of too ijood a quality for ■ his business. The plaintiffs purchased the resin, and four days later forwarded to tho defendant a cheque for the difference between the value of the soda crystals and the resin. Seven months later the defendant, it was alleged, asked for the loan of six casks of resin until t.lie arrival of a shipment .from Syduey which defendant .was expecting. The resin was not returned, consequently a demand was made for payment, and as this was not complied with, legal proceedings wore taken. The defendant counter-claimed for £48 6s. 6d., the balance alleged to be due on the two [ tons sold .to plaintiffs in. 1918. The value of the two tona~waa £93'95„ of which £45 2s. 6d; was paid. . The balanc. was demanded, and the reply was that payment would be'made when the weights had been adjusted. The defendant denied ordering, soda crystals, but stated that' two tons were 1 sent to his place, which he stored at tile request of the plaintiff. He had no use for soda crystals, an<t did not use them in his business.
