COMPENSATION CASE
— ■■ —♦— A COMPLICATED MATTER. . f By Tolegraph—Press Asuociation. Auckland, May 20. The Arbitration Court has forwarded to Auckland its judgment in the compensation case David Remnant v. John Dempsey, coal merchant. The plaintiff, was incapacitated from work following an accident which happened to him in May, 1919, while ho was in defendant's employ, but the matter was complicated because he was suffering at jtho timo from arte'rio oelerosis (progressive hardening of, tho arteries), which was bound to incapacitate him sooner or later. The question for the Court was whether he should bo awarded a lump sum in respect of future incapacity, in rdace of a weekly allowance such as he had received since his accident. The Court decided that the probable period of incapacity from the 'acoident was two rears, and awarded a lump siim of .£2OO to cover that period, reserving the right to plaintiff's dependants to claim compensation, should lie die within that period, on the ground that his death was du? to the effects of 'the accident.
