> . TERMS OF AGREEMENT. • London, March 9. The case of 1 Morton and C'o. v. W. M. Hughes (Prime Minister of Australia) came liefore tlie Lord Chief Justice, ill', D. Hogg. K.C.. on behalf of Mertons, said that the directors of the company thought' that Mr. Hughes's speeches, re-, fleeted upon their personal characters, but. the Court would- learn from Mr. Hughes's. counsel that while the defend JiTct made various allegations against an international organisation he made none against any of the. directors or officers'of' the company. In these circumstances tho- liauidator felt that no- good object could be served by continuing the action. The parties had agreed, subject to the Court's. approval, to stop the action.

Mr ; Hogg added tlmt while no doubt some of fhe Merton family were German, on the other hand some were English, including the lato F. Merton and E. R. Merton.

Mr. Bevan. on behalf of Mr. Hughes, said- that his client had not mndo any allegation reflecting upon the. individual directors., or officials. He simply did what he considered his duty in speaking about international organisations which he regarded as. a danger to the Empire.

The Lord Chief Justice said the action could he staved on the terms recorded in the briefs—Aus.-N.Z; Cable Assn.
