DEFENCE NOT ACCEPTED

CONVICTED AND FINED £10

The Gravndler case was concluded in the Magistrate's Court yesterday, when Mr. E. Page, S.M., declared his decision. The defendant, Charles Grayndler, was dealt with on three charges of il.l-treat-ine his child r en so as to cause them.unnecessary suffering.

"I have come to tho conclusion," said His Worship, "that I must enter a conviction on these charges. The facts are admitted, but the defence set up is that at. the time he committed the acts lie was a lunatic, that is, ho was in no way resDonsiblo for what ho was doing. There is no doubt that the defendant was ill at the time. This is borne out by the medical evidence and the, evidence of friends of the defendant. But the evidenco falls short of that required to establish bevond all doubt that the defendant was insano at tho time. The assaults in this case are somewhat serious, and I think it my duty to impose a fine."

Counsel for the defendant, Mr. H. F. O'Leary, suggested that the situation would be. well met if Grayndler were bniind over to keep the peace.

However. His Worship decided on tho infliction of a fine. On the first charge the defendant was fined .£lO, and on each of the' other two charges ho was convicted and ordered to come up for. sentence when culled upon. Fourteen days were allowed in which to pay the fine.
