Biddell, S.M., each heard some of the cases in tho Magistrate's Court yester--1 day. , i Henry Richard Balding, ■■-„- for being found in a state of intoxication, was ' fined 10s., in default three days' imprisonment. POSSESSION OF A HOUSE 1 . i G. Hemingway, J.B. Martin and J..C. Offer sued Helen Barry for the possession n of a houso and thn recovery of £2 lis. 9d. rent. Mr. J. Scott appeared in support of tho claim. After hearing evidence. His Worship made an order for possession in four weeks and gaye', judgment for the amount claimed, with" costs (.£1 175.). BY r LAW CASES. For driving motor-cars at excossivo speeds, Harold Brown was fined 30s. ma costs (75.),- Francis Newman (two charges) 305..- and costs, and £i and costs. For a similar offence B. P. Brown was convicted and discharged, and for negligent driving when turning a corner was fined >£3 and costs' (155.). Thomas H. Callinghnm was fined 30s. nnd costs (75.) for riding a motor-cycle across the intersection of Bunny Street and Lainbton Quay at a speed exceeding eight miles' per hour. Charles Thomas Pudnoy was fined £\ nnd costs for leaving two horses a lorry unattended by' the Toadsido. ,Fpr u similar offence in. respect of a motorcar, Neil C. Burns was fined £2, with costs. . R, H. Blow admitted attempting to board a car while in motion and wn9 fined 10s.' nnd „7s. costs, and Ernest E. Pope, for doing likewise, was ordered to nay costs (155.), James A. Ryan pleaded not guilty to a chargo of failing to stop a motor-van •when requested to do so by a police eonstable. He wis convicted nnd fined 10s. nnd ordered to pay costs (155.). For furiously drivinc a horse along 'Adelaide Road, a young man named Stewart Frnzer was mulcted in the sum of 305. and costs (75.). While a passenger on a tramcar, Ida Esther Gribble failed to pay her fare. This offence cost her 10s. and 15s. costs. James Joseph Moore was charged with burving a horse within the city—in the sand on the town side of Lyall Bay and \SO feet away from a dwelling. It van alleged that the inspector was attracted bv tho stench, but this was denied by defendant's son. who appeared on defendant's behalf. Moore- was fined £3 and costs (75.). UNDEFENDED A CTIONS. Judgment was given for plaintiffs by default in the following undefended cases: Mrs. Keirander v. W. Kelly, £2 and lis. costs; Hope Gibbons and Sons and J. B. Clarkson, Ltd. v; James Hoy, .CIS IK 2d., and costs 055.1t Champion nnd Co.. Ltd. v. Ronald Warden, iIG 16.?. W. and costs (£1 10s. Cd.). DEFENDED SUITS.; In the cases John Batemnn Harcourt and Charles James Stanton Harcourt v. Catherine Wheatley (separate estate), judgment was given for nlaintiffs for .£35 and costs .£5 lis.; Flockton and Co. v. Alexander Manks', judgment for plaintiff for £9 23. and .£2 17s. costs. In tho judgment summons case F. B. Lieber v. Charles H. White, defendant was ordered to pay the sum of .£ls &3. 6d. at tho rate of 10s. per- week. Decision was reserved in a civil action in which Alexander I.awson claimed from Georgo and Sarah' Oudaille .£37.105.. as commission on a sale of furniture and a houso at No. 110 Wellington Terrace, and £20 general damages, the claim being for expenses involved in prepar. ing and performing an agreement for the alleged sale. Defendant-alleged misrepresentation and claimed the amount of the deposit (,£10). Hector Maurice Bramul claimed £12 .from Sydney Jackson,.plumber,.for damages alleged to have licen suffered as a result" of'unlawful trespass;?: WP. Young appeared for .plaintiff and Mr.'. W. Perry for defendant. Judgment was given for plaintiff, for £2 and costs. .. :
