ALLEGED FALSE PRETENCES

BUSINESS MAN'S NAME USED. Nine charges of false pretences were preferred ngainst Herbert Maloncy bi , - fore Sir. W. G. Kiddell, S.M., at the Magistrate's CW't yesterday. The informations alleged that on divers dates between. July 38 aud September 10, the accused obtained nine eases of whisky, isf a total value of ,£45, by means of a fslso pretenoe from the following firms: —Messrs. Ellis and Mantou, Pearson and Co., Laery, Bevorid.se, nnd Co., Levin and Co., and E. T. Taylor. -The prosecution alleged.that the accused used the name of Mr. G. Nash, of Wadestown, in order to obtain the whisky. Detective-Sergeant Kawlo prosecuted, and Mr. P. B. Broad represented the accused. Mr. W. L. Dothenberg -watched tho c<\sq on behalf of Srr. G. Nash. Frederick William Manton, partner in tho firm of EKis and Manton, general merchants, said that on August 2G he received an order by tho telephone for n enso of -whisky to be prepared for Sfr. Nash. Witness acted upon the instructions, thinking that everything was in order. The value cf the whisky was £1 18s.. Gd. ' Francis William Grant, erorenian for Messrs. Ellis and Manton, said that ho handed tho case of whisky to the accused, as he -understood that ho was the agent for Mr. Nash. Alfred Holt, head stnrctnan for Ellis and Wanton, shid Hint the accused called on August SO for a case of whiskv and presented a docket made out to Genrse N'nfh. Witness gave him the whisky and the accused eigncd tho invoice "G. Nash." AVitness did not know Mr. Nash. Nellie Namio'ted, employed by Messrs. Pearson and' Co., said that on August 25 a telephone message was received from someone purporting to be Geor"e Nash asking for a case 6f whisky. This was prepared, but was not ca r .led for. On September 1 another message was- received, and tho voice said that sninrone would be s.?nt for it. The aroused called abijiit a quarter of nn hour later, and said that he had callryl for a case of whisky for Mr. Nash. He produced an order signed "G. Nash." Witness gave him the whiskv ami accused signed the invoice "H. Tleno." Witness s?nt two iuvf to Mr. Nash, who eai'.led in and s-aul that the ,?oods had not been bought by him or for h'iin. Leonard "Ralph, storemati for Pearfiou and Co., said that he received a telephone .niesMge for .a caw of whisky on September 8, and the accused called at: the office and asked for tho o.ise of whisky for SFr. N.t-ili.. The whisky was handed over, and the'edwd signed the invoico "G. pnr H.H." Similar evidence wa? given by renre-sc-ntat'ves of the other firms concerned. As the evidence was imt concluded yesterday, tlie ease \v«s adjourned till Saturday morning. Bai' was allowed in the sum of .£75, and one surety of .£75.
