FALSE PRETENCES
ALLEGED TIPS FROM A. JOCKEY. By Telegraph—Press Association. Auckland, August 25. Two charges of having, obtained JB9; ■and A' 3 from Terence Uirno by falsa pretences wero luid against Herbert Lipsiium, bet'oro. Air. Wilson, S.M., at tlio Police Court. Tho lalso pretences alleged wero that tho accused had had a telegraphic communication with ami iroiu tho well-known jockey Jack O'Sliea, respecting tlio winning chances of certain racehorses named, respectively, Pleasant Mount and Beeswing, then due to compete at the Metropolitan Trotting Club's Mooting at Cliristchurch, and Gang Awa' and Buttlo Array ilie Canterbury Jockcy Club's race meeting at Iticcarton early this month. Curn'o stated that he and accused arrived in Auckland early this month. As the rosult of statements mado by the accused respecting tip lie had received from O'Shea, who, ho said, was riding at Chriotcliurch, witness gavo him .CO to back certain horses. He received 110 dividends, and later found out that O'Sliea was not in tho country when the meetings were held. •
The police evidence went to show that O'Sliea did not participate at either meeting.
Accused 6aid that ho had been a racehorse owner and was consequently "well uu" in racing matters. It was from O'Shoa's punter and not direct from tho jockey that he got his tips. He at first denied that Curno hud given him money, but later he admitted it.
Tho Magistrate accepted (Junto's version of the transaction and sentenced accused to three months' imprisonment on each charge, to bo concurrent.
Lipsham was further charged with heine a military deserter, ami ho was ordered to bo handed over to the military authorities at the expiration of his term of imprisonment.
