CARGO BROACHING
CLAIM AGAINST SHIPPING COMPANT FAILS. (By Telegraph-Special Correspondent.) Wanganui, July 31. A case of considerable interest to those business people who occasionally suiter losses on account of cargo broaching has just been determined in tho case of tho G. H. Powmill llubbs-r Company and the Patoa Shippiiiy Company, in which tho plaintiffs claimed for damages in connection with the broaching 61 cargo on the Kapiti. The Magistrate held that tho local company v/a-i acting as a subcontractor under the Shaw,' Savill and Albion Co., and that it was to the latter company thu plaintiffs mint look for ie-dre-ss and not to the l'ntea ■ C'oiiirm.v. Further, ■ tho Magistrate stated Hint it lay in tho plaintiffs' hands to show that tho easo had been broached while in the hands of the Patea Shipping Co., nnd lie was not satisfied that the plnintiif had excluded tho possibility of the wso having been interfered with after it kft the ship, and while it was still lying in the wharf shed, and nonsuited tho plaintiffs.
