Supromo Court Victor Kuport Andortiou was charged with escaping from , legal custody while under remand for thoft. Ho disappeared from tho Waikato Hospital, whore he was undergoing treatment. Counsel moved to quash the indictment, claiming tlmt accused was not in lawful'custody at tho timo of his' escape. His Honour said this was tho first timo tho question had arisen in New Zealand. Tho jury returned a verdict of guilty on the facts, but tho point whether accused had been in legal custody on. a criminal offence was reserved for the Court of Appeal.
