COLOURED MAN CHARGED ALLEGED THEFT OF CLOTHING His Honour Mr. Justice Hosking presided at the Supremo Court yesterday, anci heard' the second charge against a coloured man named James Arthur Pollard. alias Archie Taylor, who pleaded not guilty to breaking and entering the premises of Messrs. Cody and Co., in Courteiuiy Place, 011 March 19, and stealing 'therefrom a quantity of clothing and Material valued at '.£IBO. Air. P. S. K. Macassey, of the Crown Law Office, appeared for the Crown; tho prisoner was not represented by couusel. Mr. Joseph Haitdloy was foreman of the jury It' was stated in evidence, which wassimilar to that given in tho Lower CourL. that tho accused and a while man named M'Douald called at the shop a lew days boioro the theft and asked for a reel of silk, and also inquired if piece silk was stocked. Accused was shown the piece silk, and took some patterns away with him. The two men returned to the shop later the 6ame day, and asked for a pair of men's gloves, but said nothing about the silk. Each man purchased a' pair of gloves, the accused tendering small money and the white man tendering a >05 note. On tho dnto in question 'laylor and M'Donald called at the house of Elizabeth Mitchell, No. 400 Evans Bay 3{oad, and left a parcel. On tho morning of March 20 Mr. W. J. Cody, principal of tho firm of Cudv and Co., discovered that somo of the contents of tho shop had been stolen. Entrance had been gained through a small window at tho back of tho shop, tho bars across the window having been removed. Tho house occupied by the accused at No. 5 Alpha Street was searched by Detective Andrews and Constable Black, but none of tho stolen property was found. Later a search was made of No. 4GI) Evans Bay Road; and there they found certain articles which had been stolen from Cody and Co.

Mrs. lu'iiKor, a small shopkeeper in Cambridco Terrace, said tliat about two months ago a dark man camc to her shop with a-parcel of silks; tho colours were blue, cream, brown, and khaki. She was asked to measure the silk. Sho measured tho blue silk roughly, and there v.eru about twelve yards. Tho man who calied was a coloured man, but witness could not say whether it was accused, Tho man said ho wanted n costumo mado for his wifo. This was tho only new evidence.

The jury spent an hour in consultation. and then returned a verdict of not fcuilly. Tho accused, who had been found guilty on another charge on Monday, was remanded until Friday.
