' It.was stated that three persons en-: tered the hotel at nine o'clock and asked for drinks. • The licensee supplied, soft .drinks, exposing the licfuorsaii tlio' bar. The; Magistrate was satisfied as to the bona fides of the licensee, but i he convicted the three persons of be-; ing unlawfully 'on' licensed -premises.: holding that, they ;had gone in for the; purpose of trying to obtain into.xi-; cants,.nrid that their entry was illeHe dismissed the informations against tlio licensee,, hqlding. -tliat leav- ■ ing the side door oDen was not a breach of the Act, and that .the presumption ; that any person could have bought intoxicants was negatived by the evidence.
