Auckland, December 20. ■ Mr. Justice Stringer gnve a decision of importance under the Workers' Compensation' Act as to. what is a miner's average weekly earnings. Plaintiff's nverago weekly earnings were admitted to be £i 4s. 4d., on which basis compensation had been paid for accidental injury. Plaintiff now contends that, as miners did not usually work full time, as lie earned .£4 4s. 4d. in four days of tho week, his average earnings were ,£5 10s. The defence contended that Sub-section 2 of the Act directly aimed nt meeting the unfairness of forcing an employer to pay compensation at the maximum rate whero workers deliberately abstained from work because by special exerlion they were able to earn substantial 'pn.v on less than the full numbe.r of days; The Court agreed with l'\e defence, and gave judgment against the plaintiff.
