The Magistrate held that'sufficicnt nolice of intention to work special overtime from 10 p.m. to S a.m. as laid'down in.the agreement had not been given by the employers to tho union. • A'oiico to individuals! of tho union was insufficient, Notice must bo given by posting the names on a notice board, with the houis to be worked within the time,- arid as specified in the agreement. Notice wns no so given. There had been no breach of tho award.
Turning to the question raised by the prosecution that; a breach of the award whs not necessary to constitute a breach of the War Regulations, Mis Worship decided that where tko '■egiilations eouftictecl with the agreement I hey could not apply. Upon the point cf illegal combination he held that the. men had merely acted in concert to uphold thi> agreement:. 'The case against Olds wus dismissed, and .'JU uimilnr oases ■ were adjourned for a. week pending instructions from the Department.
