Prazeiy S.M., presided, at tlio Magistrate's Court yesterday, and dealt with tho police and by-law. cases; ' Pot insobriety, two first offenders; who failed to appear, had their, bail of 103. each estreated. Guy Cockburu for comniitting'ai breach for his prohibition order was fined £2, in default seven, days' imprisonment, and for.being found drunk he was convicted and discharged.

JUDGMENT SUMMONSES. In judgment summons cases, F. Waehbourne was ordered to pay S. Smith and Sons .£ls Bs. by November 19, in default 14 days' imprisonment; John Abbott was ordered to pay Benjamin Woolley £W 11s. 6d. by the same day or undergo Jen. days' imprisonment; Alan-George Smith was ordered to pay Alice Dowman £i by November -19, in default four'dujvs' imprisonment. .

EJECTMENT CASES. Claims for possession of tenements aro now-made regularly as part of the civil proceedings of tho Court, but yesterday a caso somewhat different to those usually doalt with carao before Mr. F. V. Frazor, S.M., when tho Colonial Mutual Lifo Assuranco Society, LM., sought to obtain possession of a dwelling in Maaraina Crescent, occupied by P. Bitossi, in order that Matthew Rdntloy, who had recently' purchased tho [property, might! enter.into possession. ■ The latter stated, that ho had a house in Kelburn, but desired to live in tho smaller, honso for tho sake of economy. In reply to tho Magistrato as to what, he intended to do with tho Kelburn house,' Routley said that he supposed'it would remain empty until it was sold. "That," remarked Mr. Hindnmrsh, "is almost an offenco in Wellington at present." The Magistrate agreed with that view, but in tho circumstances he would have to comply with the law,- and as the purchaser had stated that he required the house for his own occupation, and Boeing .that he had anothor hbiise and would not bo inconvenienced,' ho would.make an order for Bitossi to deliver up possession in six weeks. Mr. A. H. Hindmarsh appeared for tho defendant. .

In tho caso of G. Vndala v. W. D. Smith, judgment was given for £8 2s. 6d., tho full amount claimed, together with £2 3s. costs, and defendant was ordered to give up . possession of the tenement, by.
