CITY ABATTOIRS ' CLAIM FOR REFUND OF CHARGES •.His Honour tho Chief Justice (Sir Robert Stout) presided .at the Supreme Court yesterday, and heard the case of James Rod and Co. against the city corporation. Mr. T. Young appeared for the plaintiff, and /Mr. J. O'Siiea, city solicitor, for the corporation. Tiio plaintiffs claimed from the city corporation £277 4s. Id. for refunds from 1913 to .1917, in respect to abattoir charges, in accordance with a recent decision of the Appeal Cfeurt. The amount claimed was alleged ttSbe ilie plaintiffs' share of the total amount of the overcharges which, it was claimed were made by the council for abattoir services between 1913 and 1917.
The defence was that while the council was willing- to refund moneys which were actually in hand, a largo portion.of tho money had beei] spent on additions and extensions at the abattoir at the request of the Butchers' Association, and that so much as represented sinlcjnft fimci had been handed over to tho Sinking I'und Conmiissioners, and could not now be distributed.
After hearing evidence and argument, dt' counsel, His Honour reserved his de 'cision.
The Wellington Heat Export Company also preferred a claim for .£2075 against the city corporation similar in principle to the case of Rod v. the City Council, and in this action His Honour also reserved decision.
