ALLEGED THEFT OF LUGGAGE

.INFORMANT FAILS TO APPEAR. David M'Artluir Todd was charged iiij the Mtigistrate's Court on Wednesday, before May E, V, Fra/.eiy S.M., with the theft at 'JJuhnpe ,on Jfny 7 of one box and contents, one hat-box and contents, one valise anil contents, of 'the total valuo of .£llO, the properly of Grace Richardson. Chief-Detective Boddara .prosecuted, and accused was not represented by counsel. In opening, Chief-Detective Boddam stated that accused hail been arrested on warrant. The complainant was not present; klio had been subpoenaed, nnd he therefore asked for a warrant for her arrest, which was granted. It was decided io take the evidence of two witnesses who .had come from ;i distance to save cxiwnse, nnd of others.

Phyllis P,»yd slated that in May.- last she was at Pnhnemton North, ami there saw the accused, and later she .taw him at Feilding and Taihape. Prior to her arrival at Taihape- witness had made arrangements to have her personal luggage forwarded to that town from Palnicrston North. \.Accused, under the ■ name of Purcell, was with witness on arrival of (he train 'at .Taihape. Witness obtained her own.luggage, and also saw accused obtain a, box, hat-box, and vnliso from tho luggage ofiice. Witness herself signed the hoolc "N. Martindale," at accused's request, in, respect of the second lot of luggage obtained. Witness understood that the luggage had belonged to the accused's wife, who, she was given to understand, was detid. The luggage was later stored at tho Auckland railway station, and witness' next saw a large wooden box at a private boarding-house in Auckland, where it was opened by the accused, who said witness was ..welcome to the contents. She considered them of no use to her, and therefore sold some of the goods. Prank William John Welsh, railway clerk at Taihape, identified the accused as the man who had obtained the luggage in question. Detective Sidney G. Hall, of Dimediu, read a statement made, by the accused, in which lie admitted ho had been travelling about with the woman Hovd, and when she left him he withdrew tho luggage.

At this stage. Chief-Detecfive Boddam asked for a remand for a week, whichwas granted.
