DAMAGE FOR INJURIES

Mr. W. G. Riddell, S.M., yesterday heard a case in which Julius Hansen proceeded against Henry Bpdley and Sons to recover Xl 9 10s., damages for injuries received as the result of being run into by one of Bodley's milk carts in Molesworth Street as plaintiff was getting off a tramcar. The accident, happened at the stopping placo at Pipitea Street, and the plaintiff claimed that tho driver passed the stopping place when ho should have waited until the passengers had alighted. Tho defendant urged that there was no negligence in that the tram had previously passed the horse and cart, and the horse became so frightened that tho driver was unable to pull it up before it passed the tram. Mr. 11. F. O Leary appeared for the plaintiff and Mr. T. Neavo for tho defendant. The Magistrate reserved his decision.
