CIVIL ACTIONS . COLLISION BETWEEN MOTORCARS The hearing was concluded of the case in which n claim for £20 damages arising out of a collision between two imotor-cars was made _ by Matthew Babich, fruiterer, dr Wellington, against A. A. Matter-son, taxi-proprie-tor, of Wellington. The collision occurred in Cuba Street on July 31 last, and plaintiff alleged that tho mishap was duo to defendant's negligent and unskilful management of his car. In giving judgment, Mr. AY. &. Riddoll, S.M.Tsaid it seemed to him that the'accident was due to the defendant's negligence. - Judgment was entered for plamtilt for the amount claimed, with costs £o
2s | At tho hearing, Mr. IT. ]?. O'Leary j appeared for plaintiff, and Mr. A. A\. [ Blair for defendant. MOTOB-CAR HIRE. Before Mr. F. V. Frazer, S. : M., Percy Withers, taxi-propnetor, of "Wellington, sued Fitzgerald and Pcarce, Ltd., taxi-proprietors, of Wellington, for.the recovery of £1 155., being the amount alleged to he due to plaintiff for services rendered for defendants in conveying a passenger at their'request. Mr. W. L." Bothonberg appeared for tho plaintiff, and Mr. T. iNcave for the defendants. Defendants counter-claimed for tho sum of £2 10s. for work done and services alleged to have been rendered to tho plaintiff in connection with the carriage .ot five passengers from Heretannga to-Wellington. After the hearing of evidence, His Worship allowed tho claim, which, in fact, was not disputed, but defendants were nonsuited on the counter-claim. UNDEFENDED CASES. Young v. 11. Patrick, £5S 175., costs £4 45.; Public Trustee (as administrator, of the estate of.K J3. Anderson, deceased) v. Clement F. Williams, £3 lis. 3d., costs 10s.; E. Reynolds and Co., Ltd., v. A. Sutherland, £7 10s. id., costs 10s.; Hope Gibbons, Sous, and J: B. Clnvkson, Ltd., v. Toohey Bros., £32 Is. Bd., costs £1 3s. JUDGMENT SUMMONS. On a judgment summons, A. M. Webster was ordered to pay the Wellington G lis. Co. £2 10s. by October 24, in default ■ forty-eight hours' imprisonment.
POLICE CASES. Mr. F. V. Frazer, S.M:, heard tho I police cases. Joseph Sullivan was charged with having made use of obscene language. The accused said lie did not kitow anything about the matter, as the few drinks ho had had upset him. His Worship counselled Sullivan, who is a returned .soldier, against imbibing liquor .-until he had Itully regained his health, hut said that the offence was not so serious, as the language was used to a constable. "Perhaps tho constable's feelings were not very much hurt," suggested His Worship smilingly. The accused was convicted and ordered to come up for sentence when called on within six months. For insobriety, Hugh Gill was fined £1, in default seventy-two hours' detention, and Thomas Troy was ordered to pay 10s., hi default forty-eight hours' imprisonment.
