A "MORTGAGED STEAMER. An application to sell the steamer Baden Powell, trading out of Wellington Harbour, under a mortgage for £2500. there being also owing £200 for interest and £150 for insurance, was heard by Mr. Justice Hosking at the Auckland Supreme Court on Wednet\lay (rayß the "Star"). The mortgagor, Mr. W. H. Brewer, shipowner, Wellington (Mr. Inder) is resisting the application because he has an action for damages for misrepresentation on the sale of the ship to him by the mortgagee, the Northern Bteam Shipping Co. (Mr. Durham). Mr. Durham pointed out that the action for the misrepresentation had not been commenced until twelve months after the salo of the ship. The mortgagee also asked for a prompt sale on account of the precarious naturo of the security. Mr. Inder, in opposing the application, said the action had waited until the money fell duo under the mortgage, and that they claimed a reduction of the limit due under the mortgage by the amount they were entitled to on their action for misrepresentation. As to the precarious nature of Mis security, he said that it wns jio more precarious now than it was at the time the mortgage was given, and that the ship was insured for the full amount of the mortgage His Honour adjourned the hearing to allow a further affidavit to be died as' to thr financial position of the mortgagor. Cargo will ho received np to 2 p.m. daily., except Saturdays and arrangements have been made whereby it may ho booked for delivery to any addrese in Eastbourne at a through rate of freight, which will include cartago to destination. Very little work was done on the waterfront yestorrtny afternoon owing to the heavy rain. Several ships were delayed, and among them is the Culm, which will receive further cargo for Duncdin, Bluff. Timani, and Lytlelton, till 11 a.m. to-day. The Union Company yesterday advised that tho Mararoa will thie morning receive cargo for Lytt.elton till 10.30 a.m. Tho Maori, sailing on Monday at 3 p.m., .will not receive cargo. It is also, announced that cargo for tho Lyttelton ferry steamers will be received daily till noon, and till 10.30 a.m. on Saturdays. Steamers listed to sail to-day include the Kota.ro (Messrs. G. T. Hull and Co., agents), for Lyttelton, Dunedin and Invcrcargill, cargo being received till 11 n,m.
