INTERPLEADER SUMMONS

RESERVED JUDGMENT

His Honour, Mr. Justice Hosking, delivered reserved judgment in the Supremo Court yesterday iu a complicated interpleader "summons heard by him some weeks ago. The oase was brought to,decide whether Messrs Gray and Jackson, solicitors (as trustees on behalf of certain oreditois of J. and A. Wilson, Ltd.), or tho Bank of Now South Wales were entitled to certain moneys payable in respect of tho contract for the erection of considerable additions to tho General Post Office, Wellington. At tho hearing Mr. P. S. K. Macassey appeared lor tho Crown, Sir John Findlay, K.C., with him Mr. .T. C. Morrison for tho Bonk of Now South Wales, and Mr. C. P. Skerrott, K.C., with him Mr. Douglas Jackson, for Messrs Gray and Jackson. There being no objection tho Crown withdrew from tho cn.se, and it was intimated that the Crown had paid over to Gray and Jackson the fund which it had held, by consent of the parties, in trust, and the money had been paid into a trust account. An order was made that all disbursements incurred by tho Crown bo paid by tho party against whom costs may be given on the decision of the isßue. . His Honour in a very lengthy judgment, decided the issue in favour of tho Bank of New South Wales, and tho question of costs was further reserved.
