VARIATION OF A WILL. Reserved judgment was delivered veslerday m tho Appeal Court (Second D'ivi- ■ 61011) in a will case from Christchmrch Cook v. Webb. The case was that of Irene Myrtle Cook, Dorothy Cook, and Jfairjorie Cook, appellants, and John J Richard Webb and Leicester Matson, ex- ' ecutors of the will of William Cook, de- ' ceased. The deceased left aii estate val- r ued at approximately J2(i,00l). During t hia( life he had ken living apart from i his wife, to whom he paid £2 ss. per c week, -with occupation of a. homo and c the uso of the furniture. He left the s property to his wife, with .£2 ss. per ( week, and gave to each daughter .£SOO, c together with a one-sixteenth part of J the. residue of the estate, the greater '1 part of which was, left to strangers. His 1 Honour Mr. Justice Herdman, who 3 heard tho case in Christchurch, ordered 1 the trustees to pay Mrs. Cook an addi- C tionnl JJ3 por week as from the date of her husband's death, the amount to be ' charged against that part of the estate which had been bequeathed to persons other than the wife' and children. His . Honour did' not vary the will as far as it affected the daughters. . The Court of Appeal in its judgment 5 varied the order in regard to payment f to the daughters by increasing the amount \ to an invalid daughter-to .£759, and to J> each of the other two daughters.to .£SOO. ~ Otherwise the judgment of the Court be- J low would not be disturbed, costs of all '*' parties to be paid by the trustees out Cl of that portion of the estate falling to e members of the Wakelin family.
