QUESTION AS TO TRUSTEES the Supreme Court yesterday afternoon, tho Chief Justice (Sir Robert kiioiiO neard argument on an originating summons in connection with certain juoviMons contained in the will of the late John Titlin Stewart, of Waiiganui. 'J'he application was made by the Public Trustee as executor uf the will to determine who Wore the trustees intended by the l&tntor In undertake the trust set out in tho will in respect of ft certain proiicrly at Wangnnui. 'J'he will provided that, the property in question wa3 to be utilised for purposes similar to tho.se of the I'luukel. Society, and directed that the trust be held and administered for such purposes by the .Mayor and councillors of the borough of Wu.nganui. The questions submitted for determination by the Court were:— (1) Whether tlie trustees were' (a) the persons holding offices as Mayor and ivoiuuiillors at the date of testator's dentil or any other lime, (b) the Mayor and councillors holding oftice for the time being and from time to time as the statutory executive authority of the said borough, (e) the Mayor, councillors and burgesses of the borough <.f AYaijgyniii as n corporate body. 1.2) Whether such trustees deiennined as aforesaid were legally competent to accept and administer such (rust er appoint other trustees to do so. (3) Whether the disposition of the property as provided by the will constituted a valid charitable trust. Mr. W. 3. Treadwell appeared for the Wangamii Borough Council and also for certain of the residuary beneficiaries under the will, Sir John Salinond, K.C., for the Allornev-General. Sir John Findlay, K.C., with him Mr. L. J.'K. Edwards, for Dr. Trilby King as representing the Phuket Society and Mr. 15. P. Hay for the Public Trustee. After hearing argument, His .Honour reserved his decision.
