Although smoking might not affect food injuriously, yet its odours rendered food unpleasant to the '.asfce. It was contended for tho defendant that the bylaw shouid bo directed against epitting alono, as it was the indiscriminate practice of that habit against which the by-law was Teally directed. The Magistrate held tlmt if a by-law against expectoration in places whero foodstuffs wore being sold was iwithin the competence of tho local authority, it followed that a prohibition of a practice directly inciting expectoration was also within such competence. Tho defendant was convicted and fined Is., with costs ;62 9s. Mr. J. O'Shsa appeared for the prosecution, and Mr. H. F. O'Leary for the defendant.
