DIVORCE COURT

CASE, ADJOURNED. _ His Honour Mr. Justice Hosking presided in the Divorce Court yesterday. When the case of Kmest Cltiuau l'uyuc v. Elvu Payne and another was called, Mr. (i. U. U, Watson, counsel for tltt co-responaent, announced that his client had injured his ibact seriously the previous uay, as the result of au acculeut. Ho was comined to "his bed. and was (juite uuablo to appear in Court, and lie. ihcrelore, asked ior an adjournment. Counsel iianded in a medical ccruhcato to support liis statement. Mr. H. F. O'Leary, who appeared for the petitioner, said that .if the co-re-spondent was not well enough in time to allow tho case lo be tried before a jury, petitioner might possibly waive the question of damages to allow tho case to be tried before His Honour alone.

His Honour said that ho was hardly in favour of allowing cases where misconduct was alleged to bo tried without a jury. In granting an adjournment sine die His Honour said that wherever possiblo tho Court should be made acquainted of tho possibility of an adjournment to save tho Court keeping the jury, panel 'waiting. When these breakdown announcements were made at the last moment the Court would have to seriously consider the question as to ivhether tho parties to the case should not have to pay something towards tho cost of keeping tho jury waiting.
