Mr. Justice Hosking's judgment in the civil action' dealing with the right of piupertj-holders to protect property against flood follows the Appeal Court decision, and declares that land may be ombanked against floods provided tho river channel is not interfered with; thai; Hood waters flowing promiscuously over the country are not to be treated as flowing in any channel for purposes of this rule; and tliat for any injury done to other lands by reasonable embankment for the purpose of warding off such waters no damages can be recovered by the sufferers.
