APPEAL COURT

AN INJUNCTION SOUGHT. In the appeal Court yesterday before the Chief Justice (Sir Robert Stout) and Mr. Justice Edwards and Mr. Justice Cooper further argument was heard in tho action in v which the Palmfirston North Borough Council sought an injunction restraining John Octavius Batclielar. of l'almerston North, from maintaining certain groynes he had erected in the Manawatu River, near the Fitzberbert Bridge. The dispute concerns the washing away and accretion of lands in the Manawatu River alleged to be due to the groynes erected in the Tiver by defendant. The plaintiff council claimed damages for the alleged loss of land occasioned bv the groynes, The plaintiff also claimed the land raised above the level of the river in the same locality. An injunction was also sought restraining' the defendant from maintaining the groynes. Mr. C. P. Skerrelt. K.C.. with him Mr. F. It Cooke, appeared for the plaintiffs, and Mr. 11. .Myers, with him Mr. L. L'E. Edwards, for defendant. Tlio Court reserved its decision.
