COURT OF APPEAL
—. « COLQUHOTJN V. CEOSS. In the ; Court of Appeal yesterday before Their Honours Mr. Justice Edwards, Mr. Justice Cooper, Mr. Justice Chapman, and Mr. Justice Sim, the hoaring of argument in the case of Alexander Colquhonn, of Trentham Camp, soldier, appellant, and John Cross, farmer, Masterton, respondent, was continued. The appeal was from a decision of tho Chief Justice (Sir Bobert Stout). The respondent Cross was awarded JIOOO damages by ft jury at Masterton against Colquhoun, the appellant, who it was alleged had seduced Cross's daughter. At the trial leave was reserved to Mr. T. M. Wilford, .who appeared for Colquhoun, to move for a non-suit on the ground that the girl's • evidence was not corroborated as required by the Evidence Act. The Chief Justice decided against this contention, and it was from this judgment that the appeal was mado. Mr. M. Myers, instructed by Messrs. Wilford, Levi, and Jackson, appeared for the appellant, and Sir John Kndlay, JC.C, with him Mr. D. It. Hoggard, for tho respondent. Mr. Myers continued his argument, contending that there had not been corroboration, and quoted numerous authorities in support of his contention. At the close of Mr. Myers's address, the Court intimated that it did not doBiro to hear counsel for the respondent, and tho Court reserved its decision.
