MAGISTRATE'S COURT

POLICE AND MAINTENANCE CASES. Mr. S. E. M'Carthy, S.M., presided over a sitting of tho Magistrate's Court held yesterday. Herbert I'reabury, ■who was arrested in Molestvorth Street for being jflrunk, was found to liavo in his possession a pint pewter pot, the property of James Al'Parland, Hceii3oo of the Hotel Cecil. I'ho defendant admitted .being ■ drunk, but said ho could not account for having tho pewter in his possession. lie was too drunk to remember anything. The Magistrate pointed, out to him that lie. vtas liable to tlirco months' imprisonment for theft, iiiid suggested that a ■prohibition order should be issued against, him, to which ho agreed. l?or lioing drunk he was fined 10s., in default 2-1 hours' imprisonment, ami for stealing the powter pot ho was convicted and ordered to come up for sentence when called upon, nnd a prohibition order was issued against 'Am, to bo in force for a. period of twelve months. For insobriety thrno first ■ offenders Tvoro pach fined 10s., «.ith the option of 24 hours' imprisonment. MAINTENANCE CASES. Hubert Broderick was charged with disobeying a maintenance order ior tho support of his child, the arrears amounting to .610 15s. Mr. U. }'. O'l.eary, who appeared for accused, etuted that when tho easo was before the Court in August last he produced a medical certificate' ehowiug that the man. suffered from heart disease, and wafi totally unfit for work, 'rho defendant, in giving evidence, said he was 50 jnavs of age. Ho hud beon.unable to 'work during tho past two years owing to , heart" trouble. He endeavoured to get work- in the Defence Department, but had been "turned down" on medical examination as being totallv unfit for any class of work. Hβ was dependent noiv on his brother and sister, who allowed him 10s. each. After hearing tho complainant, tho Magistrate held that ho could do nothing in the matter, and dismißsed the information. Mr. V. B. Willis appeared for the complainant.
