MAGISTRATE'S COURT

POLICE AND CIVIL CASES. Mr. S. li. M'Carthy. S.M., was on the hcnch at, the Magistrate's Court yesterday, and dealt with the police and by-law cases. For insobriety Edward .Tames Monaghan, against ivhom there were two previous convictions, was fiped £3, in default seven days' imprisonment. One first offender, a woman who failed to appear, had her bail of 20s. estreated.

Walter MonkhoUße. for whom Mr. H. F. O'Leary appeared, pleaded guilty to using obscene language in Tory Place. Mr. O'Leary Baid that, tho defendant, was a hard working man, and on returning home at the close of the day ho found his wife drunk, and it was then he. used tho language. His misfortune was that he was poor, and had to live in a poor locality, where the houses abut on the street, and anything said in the home is heard in the street. Accused was convicted and ordered to come nip for sentence when called upon. Jean Waugh. for whom Mr. P. J. O'Bcgan appeared, and who resides in the same street as toe previous defendant, was similarly charged and pleaded guilty. Mr. O'Rernn said that the remarks made by Mr. O'Leary applied in tho present case. The language was used in the woman's house, and was heard by the policemen who happened to be in the street. It was explained for tho prosecution that in this case there was a quarrel between some -women who were in th building. Waugh was fined £5 and costs, the Magistrate remarking that the limited vocabulary of such people was a reflection on our educational system.

ON LICENSED , Albert Georgo Hobbs was charge! with being found in tho Princess Hotel at a timo when such premises were reauircd to be closed. The defendant went into the hotel after 10 p.m., and was in the hotel for about twenty minutes. His excuse was that he went in to deliver milk, and tho door being locked he could not get out. He was convicted and fined 20s. and costs, in default seven, days' imprisonment. Similar penalties were imposed on Michael Boyle and Farold'.Kerr, who were found in the Masonic Hotel. A similar charge waß preferred against Richard Hankins. who was found in the Metropolitan Hotel. Mr. H. P. O'Leavy, who appeared for Hankins, explained that the defendant was a butcher, and had rone to the hotel to get orders for tho following day. The information was dismissed. SUNDAY TRADING. For Sundav trading, the following wore fined 20s. each, with costs: —Neil Blair Austin. Harrv Davis (two charges), Daisy Hilda Newberry, and Hugh George Webb. BY-LAW CASES. For driving his motor-car without headlights, B. R. Ooppock waß fined £2 aou Angus Foster was fined 20s. and costs far driving his car in Tinakori Pioad with dazzling lights. Tor leaving his car unattended in Moleswortli Street John W. Dick was fined 10s. and costs. Wm. Weaver was fined 10n. and costs for leaving his vehicle standing in Manners ■Street without locking the wheels. John Curtain, for whom Mr. P. 3. O'Regan appeared, was convicted and fined £5 and costs for driving his motor-car fn a furious and reckless manner. It was ptat"l that defendant killed a dog valued at 120. WANDERING STOCK. William John Larkin. for allowing his horse to wander (two charges), waß fined lo.i and costi or. oach charge. Similar penalties were imposed ou John Wood and Brownlee, Ltd., for allowing stock to wander. FAILING TO ATTEND DRLL. For tailing to attend drill A. Jenkins was convicted and discharged, and H. S. Proudfoot.'who asked and obtained a rehearing of hiß case, waß convicted and ordered to come up for sentence when callod upon. Proudfoot was previously fined. '
