MAGISTRATE'S COURT
POLICE CASES Mr. S. E. M'Carthy, S.M., presided at the Magistrate's Court, yesterday and dealt with the policu rases. James Vv'illoughby was charged that on .jammiy its ho did ns<.. threatening behaviour in Cuba Street whereby a breach of tho ])cace was occasioned. Accused pleaded guilty, and said ho had provocation. Mr. Marsack stated that "the only provocation the man had whs liquor." Ho was warned two or three times by a constable, but persisted in accosting people and inviting them to fight, and was eventually accommodated. Villoughby was fined 405., in default fourteen days" lmpriBonnient. . Potor Tullock was: charged with being found drunk, also with using obscene language in Manners Street. ''You have no sense whatever," remarked the Magistrate, and sentenced tho defendant to a month's imprisonment lor using obscene language, and was convicted and discharged for drunkenness. Joseph Thomas Christio was charged that being a patient at tho Avondalo Mental Hospital he did escape from that institution on December 11 hist; uJbo at Wellington did steal a motorcycle, value £100, the property ot Thomas Henry Oates; at Urcvtown did obtain from Albert Owen Casey £5 by false pretences by issuing a valueless cheque; at Wellington did obtain from Edwin Potter goods valued at £4 -k. and £1 os. in money by means of a valueless cheque, and obtained from J. 0. Smith goods to the value of £11, also by means of a valueless cheque. Chief Detective Boddani staled that as the accused was an undischarged patient of a mental hospital the police would offer no evidence in respect of the theft and false pretences charges. On the charge of escaping from Avondale Mental Hospital, the accused was ordered to be returned to the institution. For insobriety, Fountain J. Launantl James Quinn, members of the Expeditionary Force, were ordered to be handed over to the military authorities. Rudolph Johnsen was remanded for a week for medical treatment, and a nrst offender had his bail of 20s. estreated. THE CIVIL LIST Mr. }V. G. Hiddell, S.M., dealt with the civil business. In a judgment summons case Edwin Richard Bailey was ordered to pay A. Hoby and Son £14 4s. 6d. by February 12, in default ten (lays' imprisonment. ABOUT A~ TENANT. Reserved judgment was devliered for Mr. Riddell in tho case-in which Mrs. Hall proceeded against Captain V. Dunne for possession of a tenement in Talavera Terrace and rent. Judgment was given for defendant on tho claim for possession on the ground that the notice to quit was invalid, and on tho further ground that tho agreement under which the notice was given was not tho true 'agreement between the parties. The claim for rent was -left to be arranged between the parties. No costs were allowed. Mr. E. M. Slatlden appeared for the plaintiff at the hearing and Mr. H. E. Evans for defendant. A SHEEP TRANSACTION. Dalgety and Co., Ltd., for whom Mr. A. fIW. Blair appeared, claimed from Edward de Mey, fanner, Te Horo, the sum of £27 12s. 10d., balance of an account. The defendant, represented by Mr. C. IT.' Trcadwell. counter-claimed for'£3o 12s. According to the plaintiff de Mey was under agreement to sell hid sheep through Dalgety and Co. He sent a number of eheep to be sold at Feuding, where they failed te realise the reserve price. De Mey then instructed DaWty and Co. to truck the sheep to Dannevirke, -where the market was better, and have them sold by thfir agents there. The sheep reached Dannevirke at night and were taken out of the trucks at once and put into tho paddock the. following day. The shcoi) were offered for sale by Dalgety and Co. and failed to realise the reserve Tho defendant then sold the. sheep through another arrent at a lower rate. Dal«elv and Co. therefore claimed for commission and interest, and defendant counter-claimed for some sheep that (u was alleged) were not 'accounted for. After hearing evidence tho Magistrate reserved his decision. .IUVENIITcOURT In the Juvenile Court, before Mr M'Carthy. a lad aged 13 was charged with stealing ft bicycle. It was slated that the bicvclo was taken from near Messrs. Wallace and Gibson's premises in Willis Street, and was ridden about the city for two or three days, when tho boy was seen and arrested. Fis Worship committed the lad to St. Mary's, Nelson.
