GOODS SOLD BY WEIGHT
■ INTERESTING JUDGMENT. Reserved judgment was delivered by Mr. S. E. McCarthy, S.JI., in the Magistrate's Court yesterday, which is of considerablo interest to shopkeepers, and specially so.to. grocers. According to the regulations under the Sale of Foods aucLDrugs Act all goods sold by weight must have plainly marked upon the package the net weight contents and tho manufacturer's name. At the Upper Hutt Court last week J. A. Hazohvood was charged with' not complying with, tho .regulations when selling honey in. cartons. Mr. J. M. Tudhopo, of the Crown Law Office, appeared for the prosecution, and Mr. G. G. G. Watson for the defence. Tlib facts were admitted, but it was contended for .the defence that the class of goods in question would not como within those- particular regulations, as they exclude certain classes of goods, namely food substitutes 'in unsealed packages packed on retail grocer's premises for' ready sale. In this case Hazelwpod and Co. had purchased honey in bulk, and had run it off into carton packages to save the time in weighing out the quantities when ordered. Tho Magistrate held that tho packet was a sealed packet, and accordingly.came within the scopo of the regulations. Defendant was .convicted, and fined £5 and costs. Mr. Watson gave notice of appeal, security for which was fixed at £15 15s.
