POLICE AND CIVIL CASES

Mr. W. G, Riddell, S.M., was on tho Bench at the Magistrate's Court yesterday, and dealt with the police and civil business. Harry Whitburn was charged with assaulting Charles Anderson on Anniversary Day. Mr.-H. F. O'Leary appeared for the defendant, who pleaded not guilty. ■ The complainant stated that there was a heated argument amongst some men outside the r>ew Zealander Hotel, and tho defendant was shaping up, when witness endeavoured to pull him away. Defendant pushed witness, and the latter fell, striking his head on the footpath and becoming temporarily unconscious. Ho was at work as usual on the following day. Frederick Richard Stevenson, tramway inspector, stated that he was in tho tram when he saw the defendant shaping up to fight another man. \\ itness immediately got off the tram, and as he did so he saw the defendant swing round and strike Anderson under the jaw and knock Mm down. The latter was rendered temporarily unconscious. ' ' Tho defendant, in his evidence, stated that somebodv struck him and he struck back in self-defence. He was under the impression that Anderson was tho aggressor, and in turninground he struck him with hin forearm. The defendant was convicted and fined 20s. and ordered to pay costs Bs.

For insobriety, Lilian Jukes, a very •old offender, who had just been released from Pakatoa,. was fined 10s., in default 24 hours' imprisonment, and for using obscene language she was fined 405., with the option of serving seven days in gaol. Elizabeth Hani'mond, who was found helplessly drunk in Hawkestone Crescent, was ordered to pay 17s. 6d. medical expenses, in the alternative 48 hours' imprison- k ment. Georgo Browse and Rudolf Johnsen were each fined 10s., in default twenty-four hours' imprisonment. David Alexander Wright was | ordered to* pay 17s. 6d. medical expenses, in default 48 hours' imprisonment. Three first offenders were convicted and discharged. Patrick "William Lee, who was found helplessly drunk on Plirnmer's Steps, was remanded for n. week for medical treatment. A remand to appear at Waipawa on January 29 was granted in the case of David Adamson, who was charged that on April 7, 1317, he did receive money on behalf of the Tikokino Sports Committee, and did fraudulently convert the same to his own use. • CIVIL CASES. Cohen was ordered to pav Henry Wright; £3 3s. by February 7 or undergo three i days' imprisonment.

POSSESSION OF TENEMENT. Hannafi Jane Hall, widow, Talavera Terrace, .proceeded against Valentine Dunne, Civil Servant, for possession of a house in the same terrace and rent at the rata of £8 6s. Bd. per month from the date of the expiration of the tenancy, alleged to he December 10, to date. Mr. E. M gladden appeared for plaintiff, and Mr. H. E. Evans for defendant. After hearing evidence and legal argument, the Magistrate reserved his decision.
