MIRAMAR AFFAIRS
MEETING OF THE COUNCIL. The Miramar Borough Council met last evening. The Mayor (Mr. F. Townsend). presided, and there were present also: Councillors H. K. Robertshaw, W. H. Green, and H. Hawthorn. A proposal having been made that the council should enter into an agreement for the lease., of the right to graze stock on the roads within the borough, a solicitor's opinion was received to the effect that the counoil could not legally enter into the proposed arrangement. The council had no power to grant such a lease because not only was there no provision.. in the Municipal Corporations Act, or elsewhere, of a power to lease in such a manner, but the grant of such a lease would be in direct conflict with the obligations of the corporation in respect of its control of the streets and roads
within the borough. Also, the council would probably entail serious liability if damage was suffered by any member of the public, and no provision in any lease that might be entered into could effectually protect the corporation against the consequences of the illegality. ■ The council decided not to proceed with the proposal. . It was decided that the engineer (Mr. Fox) should be enabled lo attend the annual meeting of the New Zealand Society of Civil Engineers. It was reported that the'district fund account showed a debit at the bank of £29G2. The electric lighting agreement with, the city was signed. '
