ASSAULT ON THE HIGH SEAS
FIREMAN SENTENCED TO IMPRISONMENT. By Telegraph—Press Association. Dunedin, November 6. Mr. Bartholomew, S.M., gave judgment in a caso in which a fireman on a transport (James Ferguson) was charged with assaulting the first and fourth engineers of the ship. Tho legal points raised by Mr. Hanlon in, defenco were '•hat it had not been proved that the ship was cn the high seas, and that the tliip, being ' a transport, was exempt from tno Shipping and Seamen Act. The Magistrate upheld the latter point, holding that tho vessel, being engaged in transport work, connoted complete control and possession by tho Crown, which possession would bo incomplete with subjection to a provision of tho Shipping and Seamen Act. The Magistrate amended tho charge in rcspoct to tho first engineer to oil® of committing an assault on a British fliip on tho high seas, 'and sentenced Ferguson to two months' imprisonment. _ Tho charge respecting the fourth engineer was dismissed, the Magistrate stating it appeared that tho officer could have avoided a fight, but decided to deal with tho offender after tho methods of Captain Kettle."
