THE ABATTOIR ACCOUNTS

..The Court of Appeal yesterday, heard' argument upon the interpretation of section 27 of the Slaughtering and Inspection Act, 1908.' His Honour the Chief Justice (Sir Robert Stout) presided, and with him on the bench were Mr. Justice Denniston, Mr. Justice Cooper, Mr. Justice Chapman, and Mr. Justice Hoskiug. A number of questions were asked in an originating summons brought; by the Wellington Live Stock liutehers'' Association (as representing the butchers having their meat slaughtered at the Wellington Municipal Abattoir) against the Wellington City Council. The Court was asked to decide whether the defendant corporation was ontitled to charge against revenue as part of the annual cost oi the abattoir: (a). A sum of 2 per cent ■upon the capital expended m establishing and erecting the abattoir for a renewal and depreciation fund; (b) a sum of 1 per cent, upon loan moneys forming part of such capital sum as sinking fund for the redemption of the loan at maturity; (c) a sum e<iual to 10 per cent, of the amount shown in the corporation balance-sheet as expenditure for "preliminary expenses," and which represents an advance from the corporation's District Fund; .(d) sums payable tor extensions or additions to tlio abattoir and the cotage erected for use in conjunction therewith; (e) the cost of constructing a drain to convey the drainage from the abattoir or a sum payable to th» owner of the drain for the privilege ot discharging into such drain the drainage .rom the abattoir; (f) a sum reierred to in the balance-sheet relating to the abattoir account as "commission for sale of offal," being a charge made by the corporation for disposing of offal at the abattoir; (g) a sum of .£250 per annum charged by the corporation for a supervision of the abattoir by the officers ot other departments; (h) a sum changed for wages of tripe cleaners at the abattoir, the proceeds resulting from such expenditure not being placed to the credit of the abattoir account. Iho summons further asked what was the meaning of the words "aunual cost of the abattoir" contained in section 27 or the Act beforo referred-to; and whether, n the corporation had collected fees in oxcess of these properly chargeable under the section such excess could be recovered from the corporation. Mr. C. P. Skerrett, K.C., and Mr. 1. Young appeared for the plaintiffs, and Mr. I. O'Shea (City Solicitor) tor the defendant corporation. , Tho case was not concluded when the Court rose. ,
