COURT OF APPEAL
A SOUTHLAND CASE. The Court of Appeal continued its sessions in Wellington yesterday. The Chief Justice (Sir Kobert Stout) presided, and with him" on the bench were Mr. Justice Cooper, 'MrV Justice' Chapman; and Mr. Justice Hosking, ' ■ „..", ", ~ Martin L. Crowe and Michael Crowe, of South Hilleiid, in the county of houthlSria,'appealed'froitl a decision Riven- by His Honour. Mr. Justice, Sim in favour of Alexander Gerrard, of Barkly, boutlidln'the Supreme Court, the present respondent Oerrarß. sued.ihe-pvesent appellants for JCSO damages, and sought an injunction to compel the Crowes to reinove an"-embankment which caused Hooding of his land. The Court awarded £10 damages and granted the injunction. It was against this judgment that the appeal was made on the grounds that His Honour ha<l erred in ]«*• ~t T Mr 0. P Skerrett, K.C., and Mr. J. ]•'.- Lillicrap (invercarsiH) appeared for the appellants, and Sir John l'indlay, K.C.;-aiid Mr. n. B.
