SHORT-WEIGHT BUTTER

AN APPEAL LODGED. Yesterday afternoon Mr. M. Myers, (11 behalf of Messrs. Joseph Nathan <ind Co., lodged an appeal against the decision of Mr. S. E. M'Carthy, S.M., in fining tho firm JEIO on a churgo of soling shortweight butter. The grounds of tho appeal are that it was not proved that Iho butter was under weight when sold by defendants; that it was not proved that there was not a loss duo to evaporation after the butter vas sold by tho defendants; that the evidence showed that tho loss was, or might havo been, due to evaporation; that Iho defendants did not act wilfully, but took all reasonable steps to ascertain that the. sale of the butter would ar,t constitute an offence.
