I'. IV. Jackson appeared for the petitioner, Mr. 11. l'\ O'Leary liM' tIM icspcmloul, and llr. .1. .1. M'Clraih for tho corespondent. The respondent counler-petiti.mcd for tho dissolution of her marriage with the petitioner on the ground of misconduct in ChrHehurch in November, IM9, and also in Wellington iu January and February, 1915. Evidence was called on behalf of respondent and tho co-respondent. Mr. Jacksou desired to call evidence in rebuttal, but His Honour said it would shorten the proceedings if he stated that he did not consider tho grounds <:f the counter-petition had been proved. Continuing, His Honour said: "It will further shorten the proceedings if 1 state that the grounds of tno petition have not been proved, and the addressee of counsel will not change ay opinion." His Honour then gavo his reasons for coming to his decision. The evidence was very contradictory, and there was no proof iu cither case. He reviewed the evidence in dotail, showing tlic contr.adlctorincss and untrustworthinos3 of most of it. His Honour dismissed both tho petition and tho counter-petition. Costs were given against the petitioner as to the respondent £10, and £10 ior the 6ecbnd day, and co-respondent £30, and £7 for the second clay, with expenses of witnesses and disbursements. INDECENT ASSAULT CASK. Mr. W. G. Hiddell. S.M., presided at. the Magistrate's Court yesterday and dealt with the cases brought. by tho polite. John Marshall, an able-bodied man, pleaded guilty to being au incorrigible rogue in that be possessed insufficient lawful means of support. As ho had been previously convicted of ucin£ a rogue' and a vagabond, he was sentenced to a year's imprisonment. For insobriety William Conrick, against whom there were several previous convictions, was fined 405., in default seven days' imprisonment. Bryda Shechan was convicted and discharged for drunkenness and a prohibition order was issued against her, to be operative for a period of twelve months. Four first offenders were convicted and discharged. Harry Hiebardsou was convicted of the theft from a steamer of two shirt 3 valued at 10s.. the property of tho Jte-d Oioss Society of Kew Zealand, and was sentenced to a month's imprisonment. The Magistrate pointed out Mat the theft wos a. very menu one. The shirts were for New Zealand soldiers who were at tho front lighting for everyone in tho I'siniinion, and to steal the gifts intended for them was, despicable.
Theresa Kusselt was charged villi loitering in a public place tor immoral purposes, and also with being an incorrigible rogue and vagabond, and was remanded to July 18. A remand to '"lie same date was granted in the case of Denis William Quill, charged with tho theft of a silver watch and chain of the value cf £3 95., from the dwelling of 'William llannilin. t Michael J. M'Qann was remanded for eight clays on five charges of theft, three of which were from hotels. John ltobert Nicolle a married man residing at Brooklyn, appeared to answer six charges of indecent assault on little children, including a male child. CbicrDelectivo Boddam prosecuted, and Mr. 0. C. Mazengarb, instructed by Mr. H. P. O'Leury, appeared for the accused. After hearing the evidence the accused was committed for trial at the Supremo Court. Bail was allowed in £10;), and one surety of £100.
