MAGISTRATE'S COURT
POLICE CASES. ...Mr. L. G. Reid, S.M., presided . at the Magistrate's Court yesterday. James Christie Airlic and Frederick William Dowsett, who fought in the bar of the Royal Hotel, were each fined , 10s. Three charges were preferred against George Coolco:' (1) Disorderly behaviour whilo. drunk, (2) using obscene Jangunge, (3) resisting Constable Binns while in tho execution , of his duty. It was stated that Coolco. created a disturbance in Wakefjeld Street, and drew a crowd about him. When told to get away homo accused became abusive, and when the constable endoavoured to arrest him resisted violently. On the first charge he was convicted and discharged. For using obscene language ho was fined 405., and costs (>s., in default fourteen days' imprisonment. For resisting the constable he was fined 205., in the alternative to serve seven days ia gaol. A fhio of £3, in default twonty-one days' imprisonment, was imposed on Richard E. Chaplin for assaulting his wife, Margaret Chaplin. Thomas Brown, described by the policn as a man who did no work, was found by a. constable nt an early hour yesterday morning behind tho fence of tho new police station. Accused had camped in tho locality during the night. He was sont to gaol for seven daye. Herbert Lloyd Jones was charged with the attempted theft of 'the contents of a caso of whisky, tho propertv of Francis Joseph Oakes. Tho Magistrate said ho could not possibly convict on the evidenco tendered, aiid dismissed the charge. CIVIL BUSINESS. CLAIM FOR, DAMAGES. Mr. AV. G. Riddell, S.M., heard an action for damages brought by Thomas B. Morris, of Brooklyn, against J.' O'Mcara, a. retired publican, of AVeJhnjgton. Tho case arose out of a collision that occurred at Lowry Bay, betweon plaintiff's motor-cycle and defendant's motor-car. It was alleged by plaintiff that owing to tho injuries ho received through tho collision he had been unable to do any heavy work, and that his motor-cycle was severely damaged. Hβ claimed £22 16s. 6d. damages. Tho defenco was that the plaintiff was on tho wrong aide of tho road when the collision occurred. Tho caso was adjourned for a fow days to enable tho Magistrate to inspect tho scono of tho collision. , MAINTENANCE CLAIM. _ Mr. L. G. Reid, S.M., dolivered judgment in the caso of Eliza Weston, represented by Mr. P. W. Jackson, who sought to obtain an order for maintenance- for her child against Herbert Percival Jackson, for whom Mr. J. 0. Peacock appeared. According _ to evidence, the parties had been , divorced on tho husband's petition. Originally the husband ask,td for the custody of the child, but later abandoned the application, allowing tho mother to rotain custody of the child. The Magistrate dismissed tho case, and quoted decisions of the High Court of the Commonwealth of Australia to show that a Magistrate had no powers in such a case.
