COURT OF APPEAL
A SOUTHERN CASE. The Court of Appeal delivered judgment yesterday upon the appeal made by Thomas E. Fiaieber and William Fletcher, of Canterbury, against a judgment given by Mr. Justice Sim in favour of the Wainono Drainage Board. The question at issue was r to the classification of land for rating purposes, and in an originating summons the appellants .questioned 'U validity of four special rates levied by the Drainage Board. The Court unanimously hold that the case was not one for procedure under the Declaratory Judgments Act, and that the appeal must be dismissed. At the hearing Mr. W. E. Kinneruoy (Timaru) and Mr. T. A. Lucas (Waimato) appeared for the appellants. Mr. S. G. Raymond, K.C (Christchurcli) and Mr. H. F. Von Haast (Wellington) represented the respondents.
