COURT OF APPEAL
AN INSURANCE CASE. The Court of Appeal continued its session yesterday. His Honour the Chief Justice presided, and with him Their Honours Sir John- Denniston, Jlr. Justice Cooper, and 1 Mr. Justice Chapman wCro associated. Thb New Zealand Insurance Company, Ltd., appealed against a decision given by Mr. Justice Sim, at Christchurch, in favour of the Tynesidjj Propriotaryj Ltd. (a company carrying on business at Wellington as coal-mine proprietors). In the Supreme Court the Now Zealand Insurance Company claimed damages to the amount of £231 17s. lid. for breach of warranty of authority, and, in the alternative, £231 17s. lid. ■ for unpaid premium. Mr. Justice Sim gave judgment for the Tynosido Co., and it was argued for tho insurance company before the Court of Appeal that the • decision iwas erroneous in fact and in law. • ■:•■/ ' . Mr. C. T.
