Furthor argumont was heard yesterday hy. tho Court of Appeal upon an application for a'declaratory judgment rogarding tho will of tho lato. Hon. AVilliam' Barnard Rhodes. The Chief Justice (Sir Robort Stout) presided, and Sir John Dcnniston and Air. Justico Coopor were also on tho bench. Tho trustees of the, will asked the following questions arising out of its construction:—:'
(1) Did'each child of Mary Ann Moorhouso (daughtor of tho testator) take a vested interest in the residuary estate' of tho testator, subject to the life interest of their mother, on attaining twehty-ono years of ago?. (2) Is such interest, if vested, • liable to bo divested if any such child should have died, or should hereafter die in tho lifetime of the said) Mary Ann Moorhouso ? The Court reserved its decision. MILK VENDORS AND SUPPLIERS. Further argument was also heard by the Chief Justico and Their Honours Mr. Justico Cooper and Mr. Justico Chapman in a case regarding the interpretation of an agreement between Messrs. Cole, Orump, and Cundy, milk vendors, and tho Wellington Dairy Farmers' Co-op. Association, Ltd. Tho agreement was for thesupply of •certain quantities.of milk by the association to Cole, Crump, and Cundy, and it was alleged by tho plaintiffs that tho- agreement had not been properly carried out.. Decision was reserved.
