Walter Stafford, who was found intoxicated, and against whom there was a previous conviction, was fined 10s., m default three days' imprisonment. THEFT ON A ( STEAMER.'. 1 Lancelot Charles Isbern, a lad ongaged as a steward on a Homo liner, was charged with tho theft of ,a goldmounted ribbon guard and pendant, valued at £2 10s!, tho property of Albert \Benjamin Card, ship's carpenter. Detective-Sergeant Cox stated that the theft was committed on tho voyage to New Zealand, and the stolen goods were sold for 7s. Cd. to another steward, but Isbern had not recoived- the nioney. The chief steward gave tho lad a good character. The Magistrate said thefts on steamers wero far too frequent, and fined the accused £5,. in the alternative 21 days' imprisonment. CHARGE WITHDRAW. 1 The charge against James O'Connell of the theft of a pile-driver, valued at £30, the property of Wm. Davis, was withdrawn. • Inspector Marsack, who applied for the withdrawal, explained that O'Connell became possessed of the pile-driver in quite a legitimate way, and there was no imputation of disfldne'sty against him. Mr. O'Leary, who appoared for O'Connell, stated that the. pile-driver was purchased from one of two partners,; who wore the owners, and the transaction was quite an open 1 one. The Magistrate agreed to the case being withdrawn. CIVIL CASES. , Mr. W. G. Riddell, S.M., delivered reserved judgment in tho case of Griffiths and Co., morchants, Wellington, y. Charles' Schlitzkus ; fruiterer, Hastings. This was a. claim for £7 2s. 6d., tho price of lo cases of bananas sold and delivered by plaintiff to defendant. The fruit was delivered by plaintiff on a steamer at Auckland, f.0.b.,. and in good condition, and reached tho defondant at Hastings some days later in an unsaleable condition. Defendant declined to pay for the bananas,'. and claimed the right to reject the goods', and also relied for his defence on tha ground that tho bananas delivered were not of the brand ordered. Tho Magistrate held that there was not sufficient evidence 'to show that any particular Jjrand had been ordered. Tho property in-the goods passed to the defendant at Auckland, and in! disposing of tha bananas to his carrier, the.defendant had exercised his right of ownership of same. Judgment was accordingly given for plaintiff for tho amount claimed, with costs. At tho hearing Mr. S. M. Sladden appeared for plain tiff, and Mr. A. J.' Luke for defendant. • UNDEFENDED OASES..
