CLAIM FOR £1500 DAMAGES.
SEQUEL TO A MOTOR FATAMTY. By Telegraph Special Correspondent. Masterton, March 20. ' A case' of interest to the fanning community and others was concluded in the Supreme Court this evening. It appears that some mouths ago a man named H. B. Miller was riding on a motor-cycle on the Carterton Road, and as he was passing a motor-car a horso rushed'but through an open gate at the .residence of Mr. John O'Dowd, and, it is alleged, knocked Miller under the car, causing fatal injuries. Mrs. Constance Miller, widow of the deceased, now claimed £1500 damages, from Mr. O'Dowd. For tho defence it • was alleged that the Ahorse that was said to have knocked Miller down, was not in charge of Mr. O'Dowd at'the time of the accident, but in charge of his son.' It was further- alleged- that undue negligence hadjiot" been shown' 'on the part of young O'Dowd. After a lengthy retirement the ]ury . failed to agree, and. a fresh hearing was ordered.' Meanwhile counsel for, the defence will, move for a non-suit on certain points raised in the case.
