MAGISTRATE'S COURT
(ALLEGED ASSAULT ON A CONSTABLE
CASE FOR THE SUPREME COURT
: Before Mr. S. E. McCarthy/ S.M., Yesterday, tho case was resumed in which Charles Henderson was charged with causing grievous 'bodily harm to .William Fitzgerald, a constable. Dotective-Sergeant Cox prosecuted, and Mr. P. W. .Jackson appeared for tho acoused. Henderson, who is a waterside .worker, residing at 115 Molesworth Street, gave evidence AYitness alleged, with some vehomence, that Fitzgerald and Mrs. Henderson misconducted themselves beforo his eyes. Hβ gavo details of tho assault he then committed xipon Fitzgerald. Mrs. Henderson's ovidenco was taken at the Hospital, wliero she ie at present seriously ill. Tho woman stated that Fitzgerald had entered the house at hor. invitation, to see how spotless it was ,heforo ehe wont away: Fitzgerald wont all through the rooms. , She said sho consented to impropriety, tat Henderson then camo in. Tho accused reserved his defence, and was. committed to the Supremo Court for trial. Bail was allowed in the amount of £25, with ono surety of £25. .-•'■.. : ; OTHER CASES. ■. Thomas Turvey was fined £3, with the alternative of 14 days' hard labour, for being found drank in tho Magistrate's Court. William Jensen, charged with boing the father of an illegitimate child, was remanded to January 19.

.Judgment was given for plaintiff in the following cases:;—George-' Wilson Mitchell , v. A.'T. Laml>, for £10, and costs £2 Bs. 6d.; Emma Wartel v. iAlesander Faure, for £12, and £3 19s. C. and A.. Odlin Timber and Hardware Company, Ltd., sued Hickling and Laird, contractors, of Wellington, and •Thomas Lawsori;. gardener, -ofllose-. neath, for £200 for timber and building material alleged to havo' been supplied to the .defendants. Plaintiffsclaimed a lien for tho above sum, on the land'of the defendant Lawson, also a cliarge for the same amount on tho money which was now or would be payable by defendant Lawson to defendants •Hickling and Laird-in respect of their contract with him: "In connection.with the above claim, Austin' Tyler, repre--Eented by Mr. A. Dunn, claimed £1510s. from defendant Lawson, while Harold Potts, for whom Mr. Kennedy appeared, claimed £20 from defendants, Hickling and Laird and Thomas Lawson. J. M'Ewan and Joseph Piper, Justices of tho Peace, Thomas Matthew Hagan, alias Hagen, was charged with using obscene language on the recreation ground, within the hearing of passers-by. Accused was fined £10, or in default sis months' imprisonment.
