The question was reduced to one as to whether, a: duty nvas cast'on'-the GeneraV Manager" to, promote appellant in August, notwithstanding an adverse report of thq.previous February. The facts were little in dispute, although there was".nothings definite before the board against appellant, except, that he was transferred Jfro'nf ; guard, to shunter in February last. .An improvement has continued to the-present timej and Mr. Whitcombe was prepared now to give a certificate, recommending promotion. - - ■■
