SUPREME COURT

MATTERS CONCERNING WILLS In the Supremo Court yesterday tlio Chief Justice (Sir Robert Stout) dealt with several applications respecting wills. A WIDOWS REQUEST. An application was made under the Family Protection Act in conncction with the estate of Robert Morling Carpenter, of Wellington, .master painter, deceased. It was mado by his widow, and was for a further allowanco out of the estate. By the will sho had been loft tho income of the estate for her life. The Court ordered that £12 10s. pelmonth should be paid to lief for the support of herself and her infant daughter from December 1 till the child becomes eighteen years of age. When the child reaches eighteen, the matter will be reviewed. In addition tho • widow was allowed £50 for past maintenance. Mr. 0. C. Mazerigarb appeared in support of the application, and Mr. E. P. Hay for the Public Trustee as representing the persons (other than the widow) interested in the will. DESIRE TO SELL A BUSINESS. In the estate -of Samuel Thomas Wood,: of Wellington, shipwright, deceased, an application was made for leave to sell the, business of S. Wood and Son to a company, to bo formed, the purchase moneys to be paid by deposit'of cash-.and the balance in the form of mortgage debentures over the assets of the proposed company. The application was made by the widojv, as executrix of the. will. ', ' Mr. 0. C. Miizengarb appeared for the "executrix, and Mr. E. P. Hay for the.Public. Trustee. Decision' was reserved; ■ OWNERSHIP OF PROFITS. In the matter of the Public Trustee v. Smyth and others, the will of the late, John Smyth, of Kumeroa, near Woodville, was before His Honour for. inter-: pretation. : • , ■ Some twelve months ago, and under the terms of tho will, the properties left by the deceased had to be leased and the stock sold, and the question has arisen as to whom the sum ' of £5600 (profits from the working of. the property between the time of deceased's death and the date of the leasing) belonged. ." ' Mr;. E. ,P. Hay ' appeared, for the Public Trustee, and Messrs. H. F. Von Haast and H. F. O'Leary for interested parties. Decision was reserved.
