SEQUEL TO A COLLISION

DAMAGES CLAIMED Mr. L. G. P>eid, S.JI., occupied tho Bench at tho Magistrate's Court yosI terday, and hoard the following cases: As a result of a. motor-car accident i which occurred in Tinakori lload on I August 28, George Cloake, bootmaker, i proceeded against Ernest AA'hitoman, motor instructor to the City Corporai tion, to recover the sum of £50. Plaintiff alleged that on tho date in ques- ■ tiou ho was walking along Tinakon ; Road when, lie was knocked down and severely injured by a motor-car driven by tho defendant. It was alleged that ■ tho collision was duo to the defendant driving the motor-car negligently and unskilfully. The plaintiff incurred damages and expenses, and was incapacitated from work for a considerable period, and was still suffering greatly as the result of his injuries. For dlio defence it was contended that plaintiff contributed negligence. Defendant was coming tip tho road at a slow pace, and on observing plaintiff he gave two short blasts on his horn. Plaintiff immediately stopped about a third of the way across the road, and defendant gave another blast of warning, and to avoid a collision swung his car on to the wrong side of the road. When th.j car was about five yards off. plainliii, it was alleged, ho commenced to walk on across the road, and the accident unavoidably happened. Mr...E. M. Beechey appeared for plaintiff, and Mr. M. F. 1/uckic for defendant. His Worship reserved his decision. JUDGMENT BY DEFAULT. Albert Alex Davics, £7 45., costs £1 Gs. 6d. ' JUDGMENT SUMMONSES.' Judgment summons cases were dealt with as under:- 1 -. Taare Koroneho was ordered to pay E. C. Browne and Co v Ltd., the sum of £4, by instalments of £1 per month, or serve seven days in prison. AV. Thompson -was ordered to pay AV. G. Allingham tho sum of £3 45., by instalments of £1 per month, in default .seven days' imprisonment. POLICE CASES. Thomas Reeves, while in a state of intoxication, entered a certain hotel in • AVillis Street, and was promptly asked to leave by a porter. He refused to do so, and behaved in a threatening manner. A policeman happened'along and arrived just in time to prevent Reeves'from 'striking the porter. Accused' pleaded.'- not guilty to the "charge of threatening behaviour, but the evidence was against him.' A fine of 20s. was imposed, together with witnesses' expenses, amounting to 4s. Tho alternative was fixed at seven days' imprisonment. ■ Edwin Sandbrook was charged with tho theft of a jheal, valued at Is. Gd., the property of Daniel O'Connor. On tho application of Mr. H. F. O'Leary accused was remanded till this morning, bail being fixed at £10.
