MR MARTIN KENNEDY'S WILL

PROBATE GRANTED FOR £150,000

ROMAN CATHOLIC CHARITIES

By the will of the lato Mr. Martin Kennedy (dated December .24, 1915), tho Misses Anastasia Christina Kennedy and. Agnes Ann Kennedy, Charles Pc-rrin Skerrett, barrister, and A. A. Corrigan, of Wellington, are appointed executors and trustees. Probate was granted yesterday, the estate being sworn at under The late Mr. Kennedy vested in the trustees all tho lands connected with his Tikitapu Station, all education reserves, and other leasehold lands held by him from the wife of his son, John Joseph Kennedy, together with all live stock, farm plant, etc. The will sets out that the trustees arc to manage the property in the same way as had been the case three years prior -to his death until the expiry. of. the period of accumulation (21 years from his death), aud to appoint his son, John Joseph Kennedy as manager, or in some other capacity at a specified salary. Tho trustees aro to stand possessed of tho rents awl incomc of the said station, out of which Mr. J. J. Kennedy is to receive (a) an annuity of £100 a year; (b) annuity of '£600, payable monthly, and a further annuity of £100 for tho purpose of the upkeep of a motor-car for liis son's wife (payable monthly) during her life, whilst she remains his son's wife. "I further direct," runs the will, "that during tho period of accumulation my trustees may permit my son's said wife to occupy rent free her residence adjacent .to the station." ''Subject to the payment of the said annuities and annual sums," continues the will, "my trustees shall stand possessed of the rest and residue of th<t rents and income of my said station iu trust, to accumulate the same by investment .in the manner hereinafter provided for a period of 21 yoars from mr death (the accumulation _ period), and at the expiration of the said period I'declare that my trustees shall stand possessed of my Tikitapu Station, -and of the accumulations aforesaid. ■

"The rest of the estate is devised and bequeathed to the trustees upon trust, and tliey are instructed to pay the- following legacies free of estate, death, and succession duties:~ "To the undermentioned children of my 6ister Mary Glceson, or, if deceased, to their children, in equal shares namely: (1) To John Gleeson, £300; (2) to Martin Gleeson, £250. • - / " "To the undermentioned descendants of my sister, Ann Parsons, the following sums, namely : —To all the.daughters of' Charlotte M'Grath (deceased) the sum of £250; (2) to Nellie Burns, £2-50; to Lucy Hanlon, £250; to Agnes Parsons, £250. "To Amelia White, daughter of my late brother John Kennedy, £1000 (or, if deceased, to her children, equally). "The sum of £1000 to the Rev. Mother Mary Joseph Aubert, or; her successor, in the institution hereinafter mentioned in aid of the funds of the Home of Compassion at Island BSy, founded by her. . "And upon further trust to pay the following annual sums from the date of my death for a period of thirty yoars thereafter, free.. from estate, doath, and succession duties, namely: "The sum of £50 to the Superior for the time being of St. Magdala Asylum, Clirislchurch.

"The sum of £50 to the president, or other head official of the St. Vijicent do Paul Society operating within tho diocese of Wellington, in aid of the charitable purposes of that society. "The sum of £25 to.the parish priest for the time being in charge of St. Joseph's Parish, Buckle Street, Wellington, or the Roman Catholic Cathedral in the said city, when the same shall he built for tho celebration of masses during tho said period for the repose of the souls of myself and wife, and of any members of my family who shall he dead. (A similar provision is made respecting the Hill Street Basilica (Tnorndon Parish), and the St. Mary of the Angels' Church, in Boulcott Street.) . "Tho sum of £50 to the Lady Superior of the Convent of Mercy, Hill Street, for. the education of deserving poor pupils. "Tho sum of £25 to the Superioress or principal of the Roman Catholic Orphanage at the Upper Hutt for or towards the maintenance of such orphan-, age. ..." Clause 16 provides that the trustees shall hold the residue of the estate in trust for all deceased's daughters living at his death—"in equal sliares, as tenants in common, and also the issue then living, and who shall attain the age of 21. 'years,, or marry; any daughter of mine who shall have died in my lifetime, such issue, through all degrees, to take per stirpes; if more than ono, equally between them, as tenants in commpn, such share or respective shares only >as her, his, or their parents would have been entitled to absolutely if ho or she, had lived and had attained tlje age of 21 years."
